Premises liability cases involve injuries caused by unsafe or dangerous conditions on someone else’s property. These claims can arise from hazards such as slippery floors, unsafe stairways, inadequate security, falling objects, or poorly maintained walkways, where a property owner’s negligence results in injuries to visitors, customers, or tenants.

Florida Premises Liability Lawyers

When Negligence Changes Everything, You Need a Firm Built for Complex Litigation

In the State of Florida, property owners have legal responsibilities to people entering their property. However, the responsibilities owed are different for trespassers, guests, patrons, and tenants.

Silva & Silva is committed to holding property owners accountable for unsafe conditions, leveraging extensive experience to pursue justice and meaningful recovery for victims of premises liability.

Injured on Someone Else’s Property?

If you were injured due to unsafe conditions on someone else’s property, you may be entitled to compensation under premises liability law. Property owners and managers have a legal duty to maintain safe environments, and when they fail, serious injuries can occur—leading to costly medical bills, long-term harm, and pain and suffering.

Silva & Silva has extensive experience handling premises liability claims across a wide range of scenarios, including unsafe apartment complexes, defective elevators, poorly maintained common areas, and dangerous pool conditions. The firm has successfully represented victims of serious accidents caused by negligent property maintenance, including catastrophic injuries and wrongful death cases.

If you or a loved one has been hurt on someone else’s property, consulting an experienced premises liability attorney can help protect your rights and maximize your recovery.

Dangerous Conditions

What steps a property owner must take in order to protect you while you are on the property depends upon your reason for being there, or what attorneys simply call your status. If you are a trespasser and have no invitation to be on the premises of another, the owner of the land merely has the duty to refrain from causing you any willful or wanton injury, unless the injured person is a child, who was attracted to something, such as a swimming pool or even a pile of construction debris, on the owner’s premises.

However, if you have been invited onto someone else’s property as a member of the public or as a business visitor, the owner of the property owes you a greater duty. Specifically, the owner of the property has a duty to discover dangerous conditions on the property and must either repair or properly warn you about them. The owner is not obligated to look for dangerous conditions that may harm you. However, if the owner knows of a dangerous condition that could be harmful, the owner must take reasonable steps to make the condition safe and to properly warn you of the danger. If you are a tenant, your landlord has the duty to exercise reasonable care to inspect and repair common areas, stairways, elevators, and passageways under the landlord’s control.
