How Do Class Actions Work in Florida?
A Florida class action must satisfy Rule 1.220, Florida Rules of Civil Procedure: numerosity (joinder of all members is impracticable), common questions of law or fact, typicality, and adequate representation — and damages classes proceeding under Rule 1.220(b)(3) must additionally show that the common questions predominate and a class action is superior. Consumer cases often proceed under the Florida Deceptive and Unfair Trade Practices Act (sections 501.201 and following, Florida Statutes), which reaches deceptive and unfair business conduct and allows recovery of actual damages; a court may also award attorney’s fees to the prevailing party — plaintiff or defendant — at its discretion (section 501.2105, Florida Statutes). Large multistate classes may end up in federal court — the Class Action Fairness Act allows removal of qualifying class cases where at least one class member and one defendant are citizens of different states, the class has 100 or more members, and the aggregate amount at stake exceeds $5 million. Class claims arising in Miami, when venue is proper, are generally filed in the Eleventh Judicial Circuit — or in the Southern District of Florida when there is a basis for federal jurisdiction. Circuit civil cases (over $50,000) with Miami-Dade County venue are heard at the Osvaldo N. Soto Miami-Dade Justice Center, 20 N.W. 1st Avenue, Miami, FL 33128, and claims that qualify for federal jurisdiction may proceed in the Southern District of Florida, Miami Division.
Do You Need Many People Before Talking to a Lawyer?
No. Class cases often start with one person who noticed something wrong — an unexplained fee, or a product that failed the same way twice. You do not need to find the others first; counsel investigates how many people were affected. What matters is bringing the pattern to counsel while documents, notices, and transaction records are still fresh, and before limitation periods — as short as two years for some claims under Florida’s 2023 tort reform — run out.
What Should You Do if You Suspect Corporate Wrongdoing in Miami?
